UK Employment Law can be very complex. It is generally a mixture of statute law, common law, and has for a long time been influenced by the law of the European Union. Employees have a number of statutory rights, and therefore a number of potential claims against your business.
Practically every aspect of hiring staff is regulated either by statute or statutory instrument. Be it the national minimum wage, working time, right to a written contract document setting out particulars of employment, right to holiday pay, maternity leave, a right not to be unfairly dismissed, and others. But this is not over. There is the equality law, which if neglected, can prove very costly for your enterprise.
The legislation introduces a number of provisions which are left open to the interpretation of the courts. The relevant case law that is commonly applied in employment tribunals, extends over the past few decades, and for a small or even medium sized business faced with a legal issue or a claim it may be impossible to find out a right answer without a specialised advice.
Take the law on unfair dismissal, which although contained in The Employment Rights Act 1996, is supplemented by a number of authorities from Employment Appeal Tribunal, and even The House of Lords, which until recently was the highest Court in the UK.
